Authorisation of general insurers – Australia Insurance Act 1973 (Cth)

Australia Insurance Act 1973 (Cth) s14: s 14 Do not breach an authorisation condition

A general insurer commits a strict-liability offence (300 penalty units) if doing, or failing to do, something causes a breach of a condition on its s 12 authorisation, unless a s 7(1) determination applies; an individual involved under Criminal Code Part 2.4 faces a fine of up to 60 penalty units. The insurer monitors for, and escalates, a suspected condition breach as soon as it is identified, ahead of any APRA inquiry.
