Australia Disability Standards for Education 2005 s10: ss 10.1 and 10.2 Rely on an exception only when it can be shown, and comply as far as possible

A provider that fails to comply with a requirement may rely only on unjustifiable hardship (not available for Part 8), acts under statutory authority (DDA s 47), protection of public health where isolating or treating a student differently is reasonably necessary because of an infectious disease or other condition, or special measures including specialised units; the provider must demonstrate that the exception operates (s 10.1), and where unjustifiable hardship applies it must still comply to the maximum extent not involving unjustifiable hardship (s 10.2(3)).
