ASIC Regulatory Guide 166 AFS Licensing: Financial Requirements (Australia) rg166-app1-market-participants: Market and clearing participants may rely on the financial requirements of a licensed market or clearing facility that ASIC has assessed as adequate, and must meet ASIC's requirements if that assessment lapses

What does rg166-app1-market-participants require?

A participant of a licensed market, or of a clearing and settlement facility, may satisfy its AFS financial requirements by complying with the market integrity rules or the operating rules of the facility where ASIC has assessed those requirements as an adequate substitute, as ASIC has done for the ASX, Cboe, NSX and SSX markets and for ASX Clear and ASX Clear (Futures); ASIC assesses adequacy by reference to the operating rules and their enforcement, reviews when rules change, and may withdraw the assessment, in which case the participant must meet the requirements in the guide. Participants that undertake activities outside the market (for example custody) remain subject to the corresponding ASIC requirements for those activities.
