In individual and specific cases a competent authority may transfer data directly to a foreign recipient that is not a competent authority, without prejudice to judicial and police cooperation agreements, only where the transfer is necessary for its legal task under Article 47, no fundamental rights of the data subject override the public interest, a transfer to the foreign competent authority would be ineffective or inappropriate (in particular because it cannot be done in time), that authority is informed without delay unless ineffective or inappropriate, and the recipient is told the purposes for which alone it may process the data and that onward transfers need prior authorisation. The Commissioner must be informed and each transfer documented with date, time, recipient, justification and data.
