Chapter 6A: monitored medicines database – ACT Medicines, Poisons and Therapeutic Goods Act 2008

ACT Medicines, Poisons and Therapeutic Goods Act 2008 s97F-97H: Access, use and disclose monitored medicines database information only as authorised: relevant practitioners for the care of their own patients, others under a written access authority

What does s97F-97H require?

Health practitioners authorised to prescribe or supply monitored medicines may use the database, free of charge, to inform prescribing, supply, treatment or care decisions for people in their care and to disclose that information to the person or to other practitioners treating them (s 97F); anyone else needs a written access authority from the chief health officer stating its purpose, conditions and expiry (s 97G). Unauthorised access is an offence (30 penalty units), and unauthorised use, including recording, or disclosure, including communicating or publishing, carries 50 penalty units (s 97H).
