ACT Medicines, Poisons and Therapeutic Goods Act 2008
Chapters 7 to 13: enforcement, liability, directions and other machinery – ACT Medicines, Poisons and Therapeutic Goods Act 2008

ACT Medicines, Poisons and Therapeutic Goods Act 2008 s191-193: Comply with chief health officer directions about discarding, safe dealing and compliance (within the stated period and storage terms), and with any approval conditions for non-standard packaging or labelling

What does s191-193 require?

The chief health officer may direct an authorised person, orally or in writing, about discarding, safe dealing with, or ensuring compliance for a regulated substance or therapeutic good; a discarding direction must state a reasonable period and may set storage requirements until disposal (s 191), and failing to discard as directed is an offence under s 34(2). The chief health officer may also issue guidelines on dealings (s 192) and approve, with conditions, packaging or labelling that departs from the Poisons Standard if it is as safe (s 193).
